To enter on a case, you must e-file your Entry of Appearance on Case.net.  Upon entering on a case, the court will automatically continue the case to allow time to correspond with the prosecutor.  If a continuance is needed after the first continuance, you must file a Motion to Continue on Case.net.  Once the Judge approves the continuance, it will be noted on Case.net and a new court date will be set.  If you are requesting a warrant to be recalled, you must file a Motion to Recall Warrant on Case.net.   Requests for Continuances must be filed by 4:00 p.m. the day before court. 

If you would like to request a recommendation and/or discovery, you may e-file your requests on Case.net, however, you must contact the Prosecuting Attorney at ProsecutingAttorney@dardenneprairie.org or call at 636-755-5302 for a recommendation and discovery.  The Court does not forward any requests for recommendations or discovery to the Prosecutor’s office.  It is the responsibility of the Defendant’s attorney to correspond with the Prosecutor’s office.  Upon receiving a recommendation, if you have any questions about the recommendation, you must contact the Prosecutor’s office.  The Court will not be able to assist with questions regarding the recommendation.   

Please Note:  The Prosecuting Attorney requires the following information to be provided when requesting a recommendation:

  1. Copy of the attorney’s Entry of Appearance;
  2. Request for Recommendation;  
  3. Request for Discovery (if requesting);
  4. The Defendant’s five-year driving record for traffic cases; The Defendant’s criminal history report if non-traffic;
  5. Proof of Compliance for Driving While Suspended/Revoked, No Proof of Insurance, No Valid License, etc.;
  6. If the case involves and accident, provide proof of restitution or proof of responsibility from the insurance company.  NO recommendation will be provided without this information.

If the Defendant is accepting the Prosecutor’s recommendation, the signed recommendation and payment in full must be returned to the Court before the payment date on the recommendation.  If the Defendant is unable to pay the full amount by the payment date on the recommendation, the Defendant must appear in court to speak to the judge about a payment plan.  The Court Clerk cannot grant continuances on recommendations or set up payment plans outside of court.  

Failure to Pay:

If your client fails to pay the full balance on or before the court date, a court appearance will be required of your client at which time a payment plan may be requested.
Drug, Alcohol & Minor:
Drug and alcohol offenses require a court appearance for the final disposition by attorney and client.  Any Defendant who is under the age of 18 must appear in Court but may have a parent or guardian present with them.
Probation:
Please explain to your client the importance of complying and completing all conditions of the probation and the possible consequences if they fail to adhere to the probation order.
Continuances:
Please include your reason for requesting a continuance in all Motions to Continue.  Motions without a reason for the request may not be granted.  Also note that recommendations from the Prosecuting Attorney do expire.  If your client does not accept the recommendation by the date listed on the recommendation letter sent by the Prosecutor, you should contact the Prosecutor's office to request an extension.  The Court does not extend the Prosecutor's recommendations.

All requests for continuance MUST be filed by 4pm on the day before the scheduled court date.  Please be aware that any continuances filed after 4pm on the day before the Court date may not be processed in time for the Judge to review.  Feel free to contact the Clerk with any questions or concerns.
